Privacy Policy

Sauce FM LLC (the “Company” or “We”) respects your privacy and is committed to protecting it through our compliance with this policy (“Policy”). This Policy describes the information we process to provide through our website and/or software applications (the “Platform”) and any content that is made available through the Platform. We suggest you read this in conjunction with our Terms and Conditions of Use (the “Terms”, available at /terms).

PLEASE READ THIS POLICY CAREFULLY TO UNDERSTAND OUR POLICIES AND PRACTICES REGARDING YOUR INFORMATION AND HOW WE WILL TREAT IT. IF YOU DO NOT AGREE WITH OUR POLICIES AND PRACTICES, YOUR CHOICE IS NOT TO USE THE PLATFORM. BY ACCESSING OR USING THIS PLATFORM, YOU AGREE TO THIS POLICY.

This Policy may change from time to time (see Section 12 “Changes to This Policy” below). Your continued use of this Platform after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

1. Collection of Information

We collect the following categories of information:

A. Information You Provide Directly

  • Registration Information: Name, email address, Spotify account information, username, password, and other account details.
  • User-Generated Content: Rankings, playlists, comments, and other materials you create or share on the Platform.
  • Payment Information: For artist accounts, we collect payment details (e.g., credit card information) via Stripe.
  • When you Contact Us: If you contact our team via email, we will receive your email address, and may track your IP address, as well as the information you send to us to help resolve your query.

We will keep records of our communications with you, including any complaints that we receive from you about other Users (and from other Users about you) for 6 years after deletion of your account to the extent permitted by applicable laws.

It is your responsibility to ensure that your account details are kept up to date. If your contact information changes, please ensure that you update this in your account.

B. Information We Collect Automatically

  • Identifiers: IP address, device identifiers, and online activity data.
  • Behavioral Data: Interaction data, such as voting, ranking, and playlist activity.

C. Information from Third Parties

  • Spotify Integration: We access certain Spotify account data (e.g., profile information) as authorized by you.

D. Links and Platform Activities

We may keep track of how you interact with links available on the Platform including third party services by redirecting clicks or through other means. We may share aggregate click statistics such as how many times a particular link was clicked on.

For users (“Users”) who are California residents, the data we may collect falls within the following categories of “personal information”, as defined by the California Consumer Privacy Act (“CCPA”):

  • A. Identifiers, such as name, mailing address, IP address, and location;
  • B. Personal information, as defined in the California customer records law, such as contact (including email and telephone number) and financial information;
  • C. Characteristics of protected classifications under California or federal law (if you choose to provide them), such as age (only to verify if you are at least 16 years old);
  • D. Commercial information, such as products or services purchased through the Platform; and
  • F. Information on a consumer’s interaction with a website, application, or advertisement.

2. Use of Your Information

In order to deliver an enjoyable experience to you, we may use the information we collect from you to:

  • offer you our services and features;
  • contact you with information about the service (e.g., updates and new features);
  • personalize the Platform and the content we deliver to you;
  • customize the advertisements, promotional and marketing content on the Platform delivered by us or our business partners or vendors;
  • conduct research and analytics about how you use and interact with the Platform;
  • to test new technologies and processes designed to enhance and improve the Platform;
  • resolve disputes and troubleshoot problems;
  • investigate fraud, protect our legal rights, and enforce our Terms;
  • to send you information about the promotions and offers we have available by direct marketing or other modes of communication (unless you opt out from receiving such information); and
  • protect our Users and third parties from harm.

Moderation Practices

We may monitor and review accounts (including any information uploaded onto user profiles) and comments for content that indicates breaches of our Terms. If an account or comment meets certain criteria that demonstrate that the Terms are likely to have been breached, the relevant account will be subject to a warning and the user’s access may be restricted and/or blocked. If you share anything that is inconsistent with our Terms, we reserve the right to terminate or restrict access to your account.

3. Disclosure of Information

Our policy is to not disclose your Registration Information or personal data, except in the limited circumstances described here:

Service Providers – We engage certain trusted third parties to perform functions and provide services to us. We may share your Registration Information or personal data with these third parties, but only for the purposes of performing these functions and providing such services. More information about this is available directly below.

Disclosed data: This could include all data, including all CCPA Categories listed above.

Law and Harm – We will cooperate with third parties as needed to enforce their intellectual property or other rights. We will cooperate with lawfully made law enforcement requests for information from within or outside your country of residence where we are required to by law. This may include where there is an investigation into alleged criminal behavior or to protect the vital interests of a person. We may preserve or disclose any of your information, including your Registration Information, if we believe in good faith that it is necessary to comply with a law or regulation, or when we believe in good faith that disclosure is necessary:

  • to comply with a binding direction court order, or lawful request;
  • to protect the safety of any person;
  • to address fraud, security or technical issues; or
  • to protect our rights or property or those of third parties.

Disclosed data: This could include any personal data that we hold about you, depending on the nature of the request or the issue that we are dealing with, including all CCPA Categories listed above.

Business Transfers and Sale of User Data – Your personal data is a valuable business asset. Sauce.FM may disclose or sell your personal data as part of a merger, acquisition, asset sale, reorganization, bankruptcy, or dissolution. This includes:

  • Due Diligence Sharing: We may share your personal data with prospective buyers, investors, or other third parties under strict confidentiality agreements (e.g., NDAs) during due diligence.
  • Successor Obligations: Any successor entity acquiring your data must honor pre-existing opt-out requests under applicable data privacy laws.
  • Material Change Notice: If the use of your data materially changes post-transfer, we will notify you and provide an opportunity to exercise your rights.
  • GDPR Compliance: For users in the European Union, we rely on the legitimate interests basis under Article 6(1)(f) of the GDPR for processing data during such transactions.
  • Opt-Out Rights: California residents may opt out of the sale of their personal data at any time by contacting us at privacy@sauce.fm.

Disclosed data: This could include all personal data that the Company holds about you, including all CCPA Categories listed above.

Anti-Spam and Anti-Fraud – Your data may be shared with the Company’s Service Providers (as defined below), for example, to block accounts and suspected fraudulent payment transactions as part of our anti-spam and anti-fraud procedures.

Disclosed data: Email address, phone number, IP address, username, payment data, interaction with the Platform (CCPA Categories B, D, and F).

Aggregated Information – We may share aggregated information with third parties that includes your personal data (but which doesn’t identify you directly) together with other information including log data for industry analysis and demographic profiling.

4. Who Do We Share Your Data With

We share your data with:

  • Service Providers: For hosting, analytics, and payment processing.
  • Marketing Partners: To deliver personalized advertising.
  • Law Enforcement: When required by law or to protect safety.
  • Prospective Buyers, Investors, or Other Third Parties: for the purposes of evaluating and consummating business transfer under strict confidentiality agreements, as set forth in Section 3 above.

In some cases, these third parties will also use the data that they collect for their own purposes, for example they may aggregate your data with other data they hold and use this to inform advertising related services provided to other clients.

5. What Others May See About You

When using the Platform, please be careful about posting sensitive details about yourself. Your profile, comments, and other information you make available via the Platform may be viewed and shared by Users with individuals who may or may not be users of sauce.fm, which is outside your or our control.

6. Our Policy Towards Age

You must be at least 16 years old to use the Platform.

7. Links to Third-Party Services

The Platform may contain links to third-party websites and services, with which we have no affiliation. A link to any third-party service does not mean that we endorse it or the quality or accuracy of information presented on it. If you decide to visit a third-party service, you are subject to its privacy policy and practices and not this Privacy Policy. We encourage you to carefully review the legal and privacy notices of all other digital services that you visit.

8. Security and Retention of Your Information

Please note that no security measure is perfect or infallible, and we cannot guarantee “perfect security”. Furthermore, any information you transmit to us may not be secure during transmission. We recommend that you do not use unsecured channels to communicate sensitive or confidential information to us. Please do not share the password you use to access your account with anyone else.

The retention period applicable to your personal information depends on various factors, such as the necessity of retaining such information to manage your account, provide the services, comply with our legal obligations, resolve disputes, or enforce any other applicable contract or policy.

9. Your Privacy Rights and Choices

Depending on your place of residence, you may have some or all of the rights set out below in relation to your personal information in accordance with applicable data protection law. However, these rights are not absolute, may only apply in certain circumstances and, in certain cases, we may decline your request to the extent permitted by law.

  • Right to Notice. You have the right to be informed of our privacy practices regarding the collection, use, sale, and sharing of personal information.
  • Right of Access. You may have the right to request access to personal information we hold about you.
  • Right to Request Deletion. You may have the right to request that we delete your personal information that we have collected from you and are maintaining. Please be advised, however, that exceptions under the applicable state law may allow us to retain and use certain personal information notwithstanding your deletion request.
  • Right to Rectification. You may have the right to request the rectification of inaccurate personal information we hold about you.
  • Right to Data Portability. You may have the right to receive a copy of the personal information we hold about you and to request its transfer to a third party, in certain circumstances and subject to certain exceptions.
  • Right to Opt-Out of Sale or Sharing for Targeted Advertising. You may have the right to opt out of the “sale” or “sharing” of your personal information or to opt out of the processing of your personal information for purposes considered to be “targeted advertising”, as defined in applicable privacy laws.
  • Managing Communication Preferences. We may send you promotional emails. You may opt out at any time by using the unsubscribe option included in our emails. If you unsubscribe, we may still send you non-promotional emails, for example relating to your account or orders you have placed.

If you reside in the United Kingdom or European Economic Area (“EEA”), and subject to exceptions and limitations provided for under local law, you may exercise the following additional rights:

  • Right to Object to Processing and Right to Restriction of Processing: You may have the right to request that we cease or restrict the processing of your personal information for certain purposes.
  • Right to Withdraw Consent: Where we rely on your consent to process your personal information, you have the right to withdraw that consent at any time. The withdrawal of consent shall not affect the lawfulness of processing carried out on the basis of consent prior to its withdrawal.

Exercising Your Data Privacy Rights

If you have provided the Company with your personal information, you may exercise the above rights by submitting a verifiable consumer request to us by email at privacy@sauce.fm.

We will not discriminate against you in any manner prohibited by the applicable law for exercising any of your data privacy rights. In accordance with applicable law, you may designate an authorized agent to submit a privacy rights request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may be required to contact you to verify your identity or confirm the authorized agent has permission to submit the request. Authorized agents can submit rights requests by following the instructions provided above.

When submitting a request, your verifiable request must include the reference “Request for Privacy Information” in the subject line, and the body of the message must:

  • provide sufficient information that allows us to reasonably verify that you are the person whose personal information we have collected;
  • describe your request with sufficient detail; and
  • include an e-mail address or mailing address, as applicable, for us to send our response.

Depending on your place of residence, you may have the right to challenge our decision by contacting us using the details provided below, or by lodging a complaint with the competent data protection authority in your jurisdiction. 11. International Data Transfers

Please note that we may transfer, store, and process your personal information outside the country in which you reside.

Where we transfer your personal information outside the European Economic Area or the United Kingdom, we shall rely on recognized transfer mechanisms, such as the standard contractual clauses adopted by the European Commission in its decision 2021/914 of 4 June 2021, as may be amended, superseded, or replaced, or where applicable any equivalent instrument issued by the competent UK authority, unless the data transfer is made to a country recognized as providing an adequate level of protection.

12. Changes to This Policy

We may update this Privacy Policy at any time. We will post the revised Privacy Policy on our website and/or provide a separate notice to you as appropriate in accordance with applicable law. Changes will be effective as of the “last updated” date as set forth on such revised Policy. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Policy.
